Residents Seek to 0verturn Earlier Weld District Court Ruling

A group of residents is seeking to overturn a ruling that the voters’ repeal of the zoning for the Catalyst and Cascadia projects in west Greeley earlier this year was invalid. According to the Greeley Tribune, on Sept. 10, Weld County District Court Judge Shannon Lyons ruled the special election in February was unconstitutional, ending the Trollco v. City of Greeley lawsuit filed by Water Valley CEO Martin Lind. Lyons determined that the ordinance the special election overturned was an administrative action and could not be voted on.   Earlier in June, the Colorado Supreme Court ruled in Kavanaugh v. Telluride that a developer and a coalition of petitioners from Telluride could not amend a planned unit development agreement through an initiative.
