The developer behind Berthoud’s proposed Revere neighborhood is suing the town in an effort to overturn a voter-approved restriction on housing density, arguing that the ballot measure violates Colorado law. According to the Loveland Reporter Herald, in a lawsuit filed Tuesday in Larimer County District Court, Babcock Land Corp. contends that an Ballot Question 3A approved by Berthoud voters in April improperly changed the development rules for a 38.3-acre property at the northwest corner of U.S. 287 and Mountain Avenue. The initiative reduced the number of homes permitted on the property from 100 to approximately 16, a reduction of more than 80%.
